Description: Our client was charged with a DUI after waking up in a neighbor’s driveway. He had no idea how he arrived there. The police arrested him for DUI and believed that he was under the influence of a Chapter 893 substance, specifically heavy-duty medication. The State Attorney’s Office refused to drop the case. We fought long and hard for our client. We subpoenaed his doctor and provided medical records. The State still refused to drop the case. We set the case for trial and were ready to argue to a jury on our client’s behalf why he was wrongfully arrested and charged. On the morning of trial, the State Attorney’s Office agreed to drop our client’s case entirely. The hard work paid off and our client is free and clear of the legal system.
