Description: M.J.K. grew marijuana outside the residence in plain sight of law enforcement and admitted to growing marijuana when being questioned. M.J.K. couldn’t have a felony conviction and hired us to mitigate. We gathered a mountain of mitigation and sifted through to present the best argument possible. We met resistance with the less experienced Assistant State Attorneys and had to go up the chain until we found a reasonable prosecutor. Ultimately, the State did not agree to DROP the charge entirely due to M.J.K.’s prior criminal record, but agreed with us that, based upon our mitigation, the charge was properly REDUCED to a misdemeanor with a sentence of court costs and time-served, meaning M.J.K. did NOT have probation or treatment ordered and walked free of the criminal justice system that same day.
