Description: This was J.A.C.’s third arrest and second time arrested for domestic battery. The first domestic, we got dismissed. This time the charges came in as a felony. As before, we immediately, we contacted the purported victim and the State Attorney’s intake department. Because this J.A.C.’s second arrest for the same offense against the same victim and this time it was a felony, the State was less amenable to an outright dismissal. First, the State agreed that the domestic battery should be filed as a misdemeanor, and it was. Second, the State agreed to allow J.A.C. to enter a diversion program. Case closed for diversion. UPDATE: J.A.C. completed the diversion program and the case has been DISMISSED! J.A.C. is very happy and able to start a business and get loans because J.A.C. does not have a criminal history.
