Description: S.T.H. was stopped for a seatbelt violation. The officer smelled freshly burnt marijuana and S.T.H. admitted that he had just been smoking marijuana before driving and that he didn’t have a prescription. S.T.H. failed field sobriety exercises and provided a urine sample which confirmed he had smoked marijuana. We were offered a diversion program reduction to a Reckless Driving. However, after evaluating the case, we determined that it was a WINNABLE DUI jury trial and our client agreed. We set the case for trial and prepared accordingly. On the morning of the jury trial the State entered a Nolle Prosequi and DISMISSED the DUI entirely.
