Description: J.D.C. was lawfully stopped for driving without headlights at 11:06 p.m. J.D.C. had an odor of alcohol and admitted to smoking marijuana. J.D.C. failed field sobriety exercises and blew 0.51/0.57 and had marijuana (THC) and tramadol (an opiate and controlled substance) in his urine. The State would not offer a diversion program, but also did not want to face us in trial. We negotiated a reduction from DUI to Reckless Driving, and got a Withhold of Adjudication and concurrent fines on the Traffic Court Results citations (saving more than $300.00).
