Outcome: DUI REDUCED to Reckless Driving with Withhold of Adjudication
Description: M.D.I. was stopped unlawful speed. The officer noted in his report many “signs of impairment” which did not appear in the video. M.D.I. declined to participate in unnecessary Field Sobriety Exercises, so he was arrested. Upon arrest, M.D.I. didn’t see the point in giving a breath sample and declined that request as well. M.D.I. was seriously considering taking the case to a jury trial because the typical RIDR diversion plea required an Adjudication of Guilt. We negotiated with the State and got a BETTER deal than RIDR. M.D.I. was very pleased with our additional efforts and the result.
