Description: M.M.B. was arrested after a search by law enforcement revealed drugs and paraphernalia in M.M.B.’s living space. M.M.B. was admitted to drug court. After receiving and reviewing discovery, we opted out of drug court back to a regular division. I spoke with the assigned assistant state attorney and explained that we intended to file a Motion to Suppress based upon an illegal search. The ASA agreed with my assessment that the drugs and paraphernalia WOULD be suppress. Accordingly, the ASA filed a Nolle Prosequi, and DISMISSED the charges entirely.
