Charges: Violation of Pretrial Release and Misuse of 911

Outcome: DISMISSED
Description: R.L.H. was SPECIFICALLY told by his Pretrial Release Officer that he could return to a house which was the subject of an order that he was to avoid. Someone called the Polk County Sheriff’s Office when R.L.H. went to the house. Despite knowing that he was authorized by a law enforcement officer to return to the house, PCSO began an aggressive investigation, including deleting texts which proved that R.L.H. was authorized to be at the house. R.L.H. called 911 to report the crime—destruction of evidence. PCSO arrested R.L.H. the charge of Violation of Pretrial Release and Misuse of 911, basically amounting to a “contempt of cop” arrest. The arrest caused R.L.H.’s current bond to be revoked and kept him in jail for months while the State Attorney’s Office took no action on any of R.L.H.’s cases. We set all case for trial. The other case (above) was DISMISSED. Before the jury trial, the State DISMISSED these bogus charges as well.
